STATEMENT
to refute false information and to restore infringed rights
This appeal reports violations of the current legislation and shortcomings in NAAU's activity with the opinion on its improvement, with a request to promote the realization of the rights and interests of citizens enshrined in the Constitution and the current legislation and the requirement for their restoration, violated by actions (inaction), decisions of the law enforcement bodies.
Information about the activity of the organization regarding the representatives of the city of Kyiv within the RAU and the WCDCA, the location address and contact details of the Kyiv City Council of Advocates and the CSCA, the chairman, deputies, secretary and members of the Kyiv City Council of Advocates and the City State Administration Committee, in accordance with Part 2 of Art. 29 of the Law of Ukraine “On Information” is considered to be a matter of public interest as such, which ensures the realization of constitutional rights, freedoms and duties; Indicates the possibility of human rights violations, misrepresentation of the public, other negative consequences of the activity (inactivity) of natural or legal persons, etc.
Personal non-proprietary right of a lawyer to receive complete and reliable information about the activity of the organization, necessary, in accordance with Part 1 of Article 5 of the Law of Ukraine "On Information", for the exercise of their rights, freedoms and legitimate interests, is enshrined in Paragraph 5.1.1.8. 5.1. Article 5. According to information from the EPAU, this phone number belongs to Truskavets' lawyer Roman Stepanovich.
Headed by Orlov IF legal entity by the name Qualifying and Disciplinary Commission of the Bar of M [point] of Kiev (EDRPOU code 40895265) is not a body of advocate self-government in the stipulated Art.46 of the Law organizational form as the name in such form should contain the phrase "City of Kyiv", and point of Kyiv or the word of the capital. Formed in violation of paragraph 3 of Part 7, Section X, "Transitional Provisions" of the Law, by incorporation, shall not be the successor of the Kyiv City State Administration of Culture established before this Law enters into force. Substantiation of the request for a shortened consideration of this appeal
NAAU, as the manager of information, according to item 6. Part 1 of Article 14 of the Law of Ukraine "On Access to Public Information" is obliged to provide and publish reliable, accurate and complete information, as well as to check the correctness and objectivity of the information provided and to update the published information.
NAAU's web site does not contain sources of information published on it, which deprives attorneys not involved in the decisions of the bodies of advocate self-government, the right to complete and reliable information about the activity of the organization, the ability to verify the legality of such decisions for the implementation of part 2 of Art. 57 of the law.
The exercise of the right to information, in accordance with paragraph 2 of Part 1 of Article 5 of the Law of Ukraine "On Information" must not violate public, political, economic, social, spiritual, environmental and other rights, freedoms and legitimate interests of other citizens, rights and interests of legal entities.
Attorneys, by virtue of Part 3 of Article 269 of the Civil Code of Ukraine, can not relinquish personal non-property rights, nor can they be deprived of these rights.
Restriction on the self-government bodies of attorneys in the access to full and reliable information on the grounds of their non-involvement in the decisions made by the self-government bodies of decisions or actions (actions, omissions) is also prohibited by the provisions of Part 2 of Art. 6 of the Law of Ukraine “On the Principles of Prevention and Combating Discrimination in Ukraine”.
The subject of information relations, in accordance with paragraph 2 of Part 2 of Article 7 of the Law of Ukraine "On Information" may require the elimination of any violation of his right to information, and NAAU, in accordance with Part 1 of Article 276 of the Civil Code of Ukraine, is obliged to take the necessary actions for immediate restoration of the violated personal non-property rights of lawyers to complete and reliable information about the activity of the organization.
Pursuant to Article 277 (4) of the CC of Ukraine, the person who disseminated the information is denied the false information in the same way that it was disseminated. The disseminator of information provided by an official or an official in the performance of his / her official duties shall be considered the legal entity in which he / she is employed.
